- If it is not possible to present the marriage contract for reasons accepted by the judge, other documents must be submitted to demonstrate the continuity of marital life, e.g. birth certificates of one of the children, and the judge must verify the presence of the wife by the available means.
- If the marriage contract between a local female and an expat is made outside the United Arab Emirates, the validity of the contract must be verified based on the marriage requirements applicable at the Judicial Department.
- If the certification is for a person who has completed 18 years of age, his / her guardian or curator must be present.
- If the document submitted is a court judgment, it must be final and unappealable.
- Judgments issued outside the country must be certified and stamped with the execution seal of the competent court.
- If the person concerned or one of the parties fails to attend or is incapacitated, debilitated or is a legal person, the application must be submitted by a person acting on their behalf legally or lawfully, with the proof evidencing so.
- Any document issued outside the country must be attested by the Ministry of Foreign Affairs.
- If the document is not in Arabic, it should be translated by a legal translation office certified by the Ministry of Justice.
- No transaction shall be issued or attested if it is a subject of dispute between the parties at the time of attestation; or if it falls under another jurisdiction, or otherwise contravenes sharia law, legislations, public order, or regulations.
- The judge may request any document that he considers necessary to prove the incident.
