Through this service, you can apply for filing a challenge before the Court of Appeal against the judgment issued by the court of first instance, if you have the legal capacity to do so, requesting that the lower judgement be amended or set aside.

Service Process

  • Submit the application and required documents through any available channels
  • Pay the prescribed fees
  • Get a receipt of registration indicating the hearing date

  • Valid Emirates ID
  • Notarized power of attorney, in case of proxy
  • Copy of the lawyer’s or his delegate’s license card, if the request is submitted through a lawyer
  • Commercial license, if the application is made in the name of the license or its representative
  • Claim form
  • Supporting documents (the appealed judgement)

Fees

  • Claims of specified value: 5% of the claim value; provided that it is not less than AED 100 and not more than AED 10,000
  • Claims of unspecified value: AED 2,000, and shall be reduced to 50% if the appeal is related to a subsidiary matter
  • AED 2000 shall be deposited with the court treasury, if the value claim is less than the appeal value limit
  • AED 1000 as a security deposit, if the judgment is issued by the simple claims court.​

Special conditions / Important Notes
  • Claim form must clearly include the parties' details and addresses.
  • Subject-matter and geographical jurisdiction of courts must be taken into account.
  • All documents must be duly translated into Arabic by an office certified the UAE Ministry of Justice in the UAE. If documents are issued outside the country, they must be duly certified by: Ministry of Foreign Affairs in the concerned country, the UAE embassy in the concerned country, and the UAE Ministry of Foreign Affairs and International Cooperation.
  • If the other party is not a native speaker of Arabic, the claim form and all exhibits shall be translated.
  • The time limit for appeal against lower judgments is 30 days, while it is 15 days for appeal against small claim judgments
