Through this service, you can apply for an objection to a criminal judgment issued in absentia in accordance with the conditions specified by the Criminal Procedures Law.

Service Process

  • Submit the application and the required documents through the available channels.
  • Pay the prescribed fees.
  • Communicate with the competent prosecution or court using the available means, if required.
  • Get the hearing date to hear the case, if approved.

Rules and Conditions

  • The spatial jurisdiction of the prosecution must be observed.
  • Both the convicted person and the person responsible for the civil rights may appeal by way of objection to judgments rendered in absentia issued in misdemeanors and contraventions within seven days from the date of their notification of the judgment, with a report in the penal registry office that issued the judgment specifying the date of the session that was set for the consideration of the objection. This is considered a notice of summons even if the report is from the agent.
  • It results from the objection that the case must reconsidered with respect to the objector before the court that issued the judgment in absentia, and it is not permissible for the objector to be harmed because of his objection. If the objector does not attend the first session to consider the objection, the objection is considered as if it did not exist, and the objector is not allowed to object the judgment issued in his absence.
